We have particular experience in providing advice and conducting internal investigations in relation to the relatively new offence of failing to prevent the facilitation of tax evasion, which poses particular risk for businesses and other organisations.

Since the offence came into force, Fulcrum have advised a wide range of clients from fund managers to listed multi-nationals on the implications of the offence and how to put in place the “reasonable procedures” required by the Criminal Finance Act 2017. We have also recently carried out an internal investigation for an AIM listed client over concerns that certain of its “associated persons” may have facilitated tax evasion.
